The Honourable Sean Fraser, Minister of Immigration, Refugees and Citizenship, unveiled a new temporary measure on June 27th, 2023, eliminating the study permit requirement for temporary foreign workers, thereby removing restrictions on the duration of their study programs.
Background
Temporary foreign workers play a crucial role in Canada’s post-COVID economic recovery, and the government aims to aid their progress by offering study opportunities and increased flexibility. This allows them to enhance their skills, credentials, and licensing, potentially leading to higher-skilled and higher-paid employment. It also addresses the demand for essential occupations like healthcare and improves their eligibility for future permanent residence programs.
Public Policy Considerations
IRCC recognizes the challenges faced by foreign workers in pursuing desired study programs for career advancement. Previously, they could only study for 6 months or less while working, requiring a separate study permit for longer programs. This posed a barrier, particularly for those needing to validate foreign credentials. The new temporary measure, lasting three years, allows foreign workers to study full or part-time without restrictions on program length while holding a valid work permit. This applies to those with valid work permits or pending work permit extension decisions as of June 27, 2023. However, obtaining a study permit is necessary if the desired study duration exceeds the work permit’s validity.
The implementation of this measure will offer foreign workers opportunities to broaden their employment prospects and facilitate their transition to permanent residence. It allows them to increase their Comprehensive Ranking Score (CRS) by pursuing higher levels of education or acquiring qualifying work experience.
Minister Sean Fraser expressed that this policy aims to empower foreign nationals in achieving their career goals and aspirations, while also creating a potential talent pool for our labor market. By removing barriers to skill development, it opens doors for foreign-trained healthcare professionals, such as doctors and nurses, to contribute to our healthcare system.
Additionally, it provides a pathway for construction laborers to become tradespersons, thereby bolstering communities and promoting housing development. This immigration measure not only benefits employers, workers, and the economy, but also addresses critical labor shortages.
Conditions (eligibility requirements):
Based on public policy considerations, delegated officers may grant an exemption from the requirements of the Regulations identified below if:
The foreign national:
- Holds a valid work permit and the application associated with that permit was received by IRCC on or before June 7, 2023: or
- Submitted an application to renew a work permit under section 201 of the Regulations on or before June 7, 2023, and is authorized to work as per paragraph 186 (u) of the Regulations.
Other Admissibility and Selection Criteria: Foreign nationals eligible under this public policy are subject to all other applicable eligibility and admissibility requirements not exempted under this, or another, public policy.
Effective Date and Expiration: This public policy will come into effect on June 27, 2023, and will expire on June 27, 2026. The public policy may be revoked at any time, without prior notice.
